These terms cover your use of whowins.lol, operated by whowins.lol ("we", "us"). By adding a product, voting, or paying for a challenge you agree to them. If you do not agree, do not use the site.
1. What the service is
whowins.lol is a public directory and leaderboard of software products. Anyone can browse and vote. Product owners add their own product for free. To contest a listing position that already has a holder, an owner pays a listing and promotion fee; the position then changes hands only if the public vote goes their way.
2. What you are paying for
A challenge fee is a listing and promotion fee. It pays for a defined set of deliverables that we provide as soon as the battle opens, regardless of how the vote goes:
- a permanent public page for the matchup at a fixed address;
- placement of your product on that page and in the category listing;
- a generated share image and share links for that page;
- outbound traffic from that page to your site, measured and shown on your profile;
- a permanent product profile with your description, category and history.
The fee is not a wager, an entry into a game of chance, or a purchase of a ranking position. Nothing about the outcome is random: the seat changes hands only if enough people publicly choose your product. We say the same thing on the checkout screen, in one sentence: money buys the challenge, never the rank.
- Fees run from $5 to $49 depending on which listing position you are contesting.
- A position with no current holder can be claimed for free by adding and verifying a product.
- After payment the page is published within 12 hours and the public vote runs for24 hours.
- The deliverables above are provided in full whether or not the position changes hands. See therefund policy for when a fee is refundable.
3. Adding a product
You may only add a product you own or are authorised to represent. We verify this with a DNS record or a file on the domain. Adding somebody else's product is a breach of these terms and we will remove it.
4. Voting
One vote per person per battle. We run automated checks before counting a vote and we publish how many votes were removed from each battle. Buying votes, using bots, or coordinating fake accounts is a breach of these terms. We may remove votes, cancel a battle, suspend a product, or refuse service.
5. Content you provide
You keep ownership of your product name, description and logo. You give us permission to display them on the site, in leaderboards, on battle pages and in the share images we generate. You are responsible for having the right to give that permission.
6. Suspension and removal
We may suspend or remove a product without notice if:
- the domain check no longer passes;
- the listing is misleading, illegal, or infringes someone else's rights;
- we see manipulation of votes;
- a payment is reversed.
7. Availability
We do not promise the service will be uninterrupted. We may change how the leaderboard, pricing, or battle rules work; the rules in force when a battle opens are the ones that decide it.
8. Limits
To the extent the law allows, we are not liable for indirect or consequential loss, including lost revenue or lost visibility. Our total liability for any claim is limited to what you paid us in the three months before the claim.
9. Payments and seller of record
Payments are processed by a merchant of record, which appears as the seller on your statement and handles tax. Refunds are covered by our refund policy.
